Corporate membership terms and conditions
The terms and conditions of signing up for a Corporate membership with Consumer NZ or using the website as a Corporate member.
These terms and conditions form a legal contract between the Corporate Member named in the Consumer NZ Corporate Membership Form and Consumer NZ (“CNZ”). By completing the Corporate Membership application process, you acknowledge and agree to these terms and conditions.
The Consumer NZ Corporate Membership Form and these terms and conditions together form the agreement between the parties (the Agreement).
These terms and conditions govern your use of the Consumer Website (consumer.org.nz) and access to and/or use of a Consumer NZ membership or Digital Pass.
Please read these terms and conditions in conjunction with our Privacy Policy and Security Policy.
1. Interpretation
“Consumer NZ Corporate Membership Form” means the completed details outlined in the sign-up form, including organisation details, yearly membership details and individual user details, and forms part of these terms and conditions. Capitalised terms within these terms and conditions refer to the same capitalised terms outlined within the Consumer NZ Corporate Membership Form.
“Corporate Member” means the company or organisation named in the Consumer NZ Corporate Membership Form, and where applicable, all the users named in the User Details section. Within these terms, the Corporate Member may be referred to as ‘you’ or ‘your’.
2. Changes to the terms and conditions
CNZ reserves the right to amend these terms and conditions at any time. Any substantial changes to these terms and conditions will be sent to the Contact Person outlined in the Consumer NZ Corporate Membership Form.
3. Your rights of use
The Corporate Member has the right to access and use the Consumer Website and CNZ products or services, including the Consumer Advice Line. However, access to content on the Consumer Website and Consumer Advice Line may not be available if a Magazine Only subscription has been purchased.
Corporate members are not able to submit comments or reviews on the Consumer Website or participate in Consumer NZ Board elections.
4. Consumer magazine
If you choose a membership option that includes the magazine, the first magazine you receive will be the next issue we publish.
Consumer magazine is published in March, June, September and December. The magazine will be sent to your Postal Address outlined in the Consumer NZ Corporate Membership Form.
Delivery of the magazine to a Postal Address outside New Zealand will incur an additional fee to cover international postage. If your organisation is outside New Zealand and wish to receive the magazine, you will need to contact us directly to discuss the additional postage fee.
5. Your obligations
The Corporate Member agrees not to sell, assign or transfer its membership rights to any other person or organisation.
You agree to pay the Yearly Membership fees as outlined in the Consumer NZ Corporate Membership Form, or as updated from time to time and as published on the Consumer Website.
If any details outlined within the Consumer NZ Corporate Membership Form (as at the date of signing up to become a member) change, you agree to notify us promptly by contacting us at [email protected].
6. Security and unauthorised use
Corporate Member must keep, and must procure all Corporate Member users to keep, all usernames and passwords confidential and ensure use of each membership access is restricted to authorised users only.
The Corporate Member is responsible for ensuring there is no unauthorised use of or access to the Consumer Website or content supplied via the membership under any user details outlined within the Consumer NZ Corporate Membership Form. The total number of authorised users is set out in the Consumer NZ Corporate Membership Form. If you wish to increase the total number of authorised users or change the name of any authorised user, contact [email protected].
Corporate Members must not display their username(s) and password(s) on a publicly accessible web page, or otherwise make username(s) and password(s) available to unauthorised users.
You agree to notify us promptly if you:
Suspect unauthorised use of an account attached to the Consumer NZ Corporate Membership Form; or
Know or suspect loss or disclosure of a username or password.
Corporate Members are liable for any unauthorised use of the Consumer Website under their username(s) and password(s) until CNZ is notified and has updated the username(s) and password(s).
Usage of your online access will be monitored. CNZ reserves the right to suspend or cancel your access to content or services under the membership if we have reasonable ground to suspect there is, or has been, unauthorised use of your username or password.
7. Membership term
CNZ will advise users via an email of their log in details, membership commencement date and expiry date after receipt of the applicable membership fees. The term of a corporate membership is 12 months following this email.
8. Corporate membership renewal, payment and changes to fees
Following the initial payment of fees, CNZ will continue to automatically charge you annually via your preferred payment method on an ongoing basis unless you provide us with at least seven working days’ written notice prior to the end of the then current 12-month term that you do not wish to renew.
We will send a reminder by email, to the address we currently hold for you, that your next payment is due, at least fourteen days prior to charging your preferred payment method.
In the event no notice of termination is received, CNZ will contact you outlining that your next payment is due, at least five days prior to charging you. We will charge your card for the following 12-month term five days before your current paid-up period ends. The amount charged will be the same as the fees outlined in the Consumer NZ Corporate Membership Form, unless we have notified you of a price change in accordance with these terms and conditions.
Card payments will continue to be processed after your card expires if your bank issues you a replacement card that has the same number as the expired card.
CNZ reserves the right to change corporate membership fees at any time, but any such changes will not come into force until the end of your current corporate membership term.
9. Issues with payments
If we cannot charge your credit or debit card or do not receive payment owing from you, we will send an email to your Contact Person or the most recently notified email address.
If we are unable to contact you by email, or any other means, we reserve the right to suspend or terminate your access to the Consumer Website and cancel your membership.
10. Copyright
CNZ owns the copyright for all Consumer Website content, unless otherwise stated.
Corporate Members may view and copy material from the Consumer Website for your own use only. Corporate Members must not share any part of the Consumer Website with any other person or organisation.
Any other reproduction (including by electronic means) in whole or in part, must not be made without our prior written consent. Please address such requests to [email protected].
11. Non-commercial use policy
Our reports, information and ratings must not be used in advertising or for any other commercial purposes unless you are an accredited license programme partner. Learn more.
12. Links and errors
Links accessible or available from the Consumer Website are provided for your information. CNZ does not endorse and has not necessarily verified any of the information available through such links. CNZ accepts no liability for any loss caused as a result of any information or opinion contained in these links or your access to third party links on the Consumer Website.
We reserve the right to add or remove material, and correct errors. If you find any errors on any part of the Consumer Website, please report them to [email protected].
13. Viewing content
The Consumer Website is designed for modern browser versions via desktop, laptop, tablet and current smart phones running current operating systems. This includes Microsoft Edge, Google Chrome and Mozilla Firefox. The Safari browser via Apple devices including desktop, laptops, tablets and phones are also supported.
CNZ accepts no responsibility for a Corporate Member’s inability to access the Consumer Website or content associated with the membership via an unsupported browser.
14. Limited Liability
To the maximum extent permitted by law, your access to and use of the Consumer Website is at your own risk.
CNZ will use best efforts to keep the Consumer Website free from viruses and errors. However, CNZ is not liable or responsible to you or any other person for any damage or loss under or in connection with the Agreement or your access and use of, or inability to use, the Consumer Website. This exclusion applies regardless of whether our liability or responsibility arises in contract, tort (including negligence) equity, breach of statutory duty, or otherwise. To the extent CNZ’s liability cannot be excluded but can be limited, our liability is limited to NZ$100.
15. Your Privacy and Security
All personal information we collect in relation to the Corporate Member or any users associated with the Corporate Member is stored securely. Please read our Privacy Policy for more information about how we use and store personal information.
16. Termination or Cancellation of Membership
To cancel a corporate membership, please contact us at [email protected]. When cancelling your corporate membership, access to the Consumer Website and membership content continues until the end of your current paid-up period. No refunds are provided for corporate memberships cancelled prior to the current 12-month term.
CNZ reserves the right to terminate this Agreement, and a Corporate Member’s access to the Consumer Website for any breach by the Corporate Member. No refund will be provided if Consumer NZ cancels your membership for any breach of these terms and conditions.
17. Consumer Guarantees Act
The Corporate Member agrees it is acquiring a corporate membership for the purpose of a business and the Consumer Guarantees Act 1993 does not apply.
18. Jurisdiction
The laws of New Zealand apply to these terms and conditions. Any dispute arising in relation to these terms and conditions will be resolved in accordance with New Zealand law.
19. No Representations
These terms and conditions set out everything agreed by the parties relating to your use of the Consumer Website and supersede and cancel anything discussed, exchanged or agreed prior to you agreeing to these terms and conditions.
You acknowledge and accept that you have not relied on any representation, warranty or agreement relating to the Consumer Website that is not expressly set out in these terms and conditions, and no such representation, warranty or agreement has any effect from the date of this Agreement.
